# Should you buy a flex or industrial condo in Austin?

A flex condo lets a small business own its space instead of renting it. Here is how condo ownership works, how SBA financing fits, and what to check before you buy.

By **Zach Roesinger**, Designated Broker, Roesinger LLCUpdated October 12, 2026[Share on LinkedIn](https://www.linkedin.com/sharing/share-offsite/?url=https%3A%2F%2Fwww.roesingercre.com%2Fresources%2Fflex-industrial-condos-austin)[Post on X](https://twitter.com/intent/tweet?url=https%3A%2F%2Fwww.roesingercre.com%2Fresources%2Fflex-industrial-condos-austin&text=Flex+and+industrial+condos+in+Austin&via=LandmanZachATX)

**Short answer:** A flex or industrial condo is a single unit inside a multi-unit building that you buy outright, while the roof, parking, drives and structure are owned in common through an owners association. In Austin it lets a contractor, distributor or light manufacturer own 1,500 to 10,000 SF instead of leasing. SBA 504 financing can cut the down payment to as little as 10%. Before you buy, read the declaration, bylaws, rules, budget and resale certificate.

## What a commercial condo actually is

A condo is a legal form of ownership, not a building type. A developer records a declaration that splits the property into units and common elements. You get deed title to your unit; everyone shares the common elements by an allocated percentage. In Texas, condominiums created on or after January 1, 1994 are governed by the [Texas Uniform Condominium Act, Chapter 82 of the Property Code](https://statutes.capitol.texas.gov/Docs/PR/htm/PR.82.htm), which applies to commercial and industrial condos as well as residential ones.

### The four documents that run the building

- **Declaration (the CC&Rs):** unit boundaries, each unit's share of common expenses and votes, use restrictions, limited common elements such as assigned parking or yard, and how the declaration can be amended
- **Bylaws:** how the owners association and its board operate, hold meetings and vote
- **Rules:** day-to-day items like hours, signage, outdoor storage, truck parking and noise
- **Budget and reserves:** what the association spends each year and what it sets aside for roofs, paving and other capital items

### Assessments and the association lien

Each owner pays regular assessments, usually monthly or quarterly, to cover common area maintenance, insurance on the common structure, management and reserves. Under Chapter 82, assessments are generally a personal obligation of the owner and are secured by a lien on the unit, and special assessments can be levied when reserves fall short. That makes the association's financial health part of your credit risk.

## Buy vs lease: how the math compares

Here is an illustrative comparison for a 3,500 SF Austin flex condo. All figures are assumptions for the example, not quotes.

| Line item | Own (SBA 504) | Lease (NNN) |
| --- | --- | --- |
| Price or rent basis | $1,050,000 ($300/SF) | $16.00/SF base + $6.00/SF NNN |
| Cash up front | $105,000 down (10%) plus closing and SBA fees | Deposit, often 1-2 months |
| Debt service | $78,349/yr ($945,000, 6.75% blended, 25 years) | None |
| Association assessments | $8,750/yr ($2.50/SF) | Included in NNN |
| Property tax and insurance | $24,500/yr (assumed) | Included in NNN |
| Annual occupancy cost | $111,599 | $77,000 |
| Principal paid down in year 1 | $15,021 | $0 |

In this example, owning costs about $34,600 more in year one, or about $19,600 more after counting principal paydown. What you get for it: a fixed debt payment while lease rates move, equity build-up, any appreciation, depreciation deductions (talk to your CPA) and control over your space. Owning wins when you plan to stay seven to ten years or more, when market rents are rising, or when your business needs improvements a landlord will not fund. Leasing wins when you need flexibility or want cash in the business. Our lease vs buy guide goes deeper.

## SBA financing for flex condos

SBA loans are built for owner-users. Under the [SBA 504 program](https://www.sba.gov/funding-programs/loans/504-loans), a bank typically funds about 50% of the project, a Certified Development Company funds up to 40% with an SBA-backed debenture, and the borrower puts in as little as 10%, with real estate terms up to 25 years. [CDC New England](https://cdcnewengland.com/post/sba-504-eligibility), a certified development company, notes the business generally must occupy at least 51% of an existing building (60% for new construction), and down payments rise to around 15% for newer businesses or special-purpose property. The SBA 7(a) program is an alternative when you also need working capital.

Condos add a lender layer. Expect the bank to review the declaration, the association budget, insurance on the common elements, any litigation, and whether other owners are delinquent on assessments. A weak association can kill a loan approval late in the process, so get the documents to your lender early.

## What to check before you buy

1. **Permitted uses:** confirm your use is allowed by both the declaration and city zoning; some condo regimes prohibit food production, auto repair, assembly or outdoor storage
2. **Power and doors:** amperage and phase to your unit, door size, clear height and whether you have dock or only grade-level access
3. **Parking and yard:** how many spaces are assigned as limited common elements, and whether trailers or vehicles can stay overnight
4. **Reserves and budget:** compare reserves to the age of the roof and paving; thin reserves mean future special assessments
5. **Resale certificate:** under Section 82.157, the association's certificate generally discloses assessments, unpaid amounts, approved capital spending, reserves, pending lawsuits and insurance; read every line
6. **Declarant control:** in a new project, the developer often controls the board until enough units sell; understand what changes when control passes
7. **Leasing restrictions:** if you might rent the unit later, confirm the declaration allows it

Have a real estate attorney review the documents. Texas buyers of resale units generally have short statutory cancellation rights tied to receipt of the condo documents, and timing matters.

## Resale and exit considerations

Flex condos trade mostly to other owner-users, so resale value depends on how many small businesses want that unit size, in that location, with that power and door configuration. Units with grade-level doors, 20-foot-plus clear height, 3-phase power and good truck access hold value best. Investors will also buy leased condos, but they underwrite them like any other income property; see our [cap rate guide](https://www.roesingercre.com/resources/cap-rate-commercial-property-value?hsLang=en). If you later sell and buy a larger building, a [1031 exchange](https://www.roesingercre.com/resources/1031-exchange-commercial-property-texas?hsLang=en) may generally let you defer gain if the property is held for business or investment use; ask your CPA.

## Austin context

Flex condos have become a common format around Austin, with units marketed in suburbs such as Leander and along the southern I-35 corridor toward Buda, aimed at trades and service businesses priced out of central Austin. At the same time, heavy flex delivery has pushed Austin small-bay vacancy well above national levels (near 18% for 10,000-200,000 SF space in 2026, per [CRE Daily, citing CoStar](https://www.credaily.com/?p=219115)), which means lease concessions are available and buyers may have pricing leverage in some submarkets. Compare the cost to own against current lease deals before you commit. Our [flex-industrial guide](https://www.roesingercre.com/resources/what-is-flex-industrial?hsLang=en) and [Austin industrial market guide](https://www.roesingercre.com/resources/austin-industrial-market?hsLang=en) cover the landscape.

## Frequently asked questions

### What is an industrial condo?

It is a unit in a multi-unit industrial or flex building that you own outright, while common areas like the roof, structure, parking and drives are owned jointly through an owners association funded by assessments.

### Can I use an SBA loan to buy a flex condo?

Generally yes, if your business occupies the unit. SBA 504 typically allows as little as 10% down for an established business, and the lender will also review the condo association's documents and finances.

### Is it better to buy or lease flex space in Austin?

Buying usually costs more cash early but builds equity and fixes your occupancy cost; leasing keeps cash and flexibility. Owning tends to make sense if you will stay seven to ten years or longer.

### What should I review before buying a commercial condo in Texas?

The declaration, bylaws, rules, budget, reserve levels and the association's resale certificate, plus permitted uses, power, parking and any pending lawsuits. Have a real estate attorney review them.

This guide is general information, not legal, tax, or investment advice. The buy vs lease comparison uses illustrative assumptions; SBA terms change, so confirm with a lender or CDC, and consult a CPA and real estate attorney before you buy. Roesinger LLC is a licensed Texas real estate broker.
