Land and development

# Industrial land development in Texas

Developing an industrial building in Texas means moving a tract through entitlements, platting, utilities, stormwater permitting and access approvals before a slab is poured. The deal works only if the finished building's NOI, divided by total cost, beats what the same building would sell for.

By **Zach Roesinger**, Designated Broker, Roesinger LLCUpdated October 12, 2026[Share on LinkedIn](https://www.linkedin.com/sharing/share-offsite/?url=https%3A%2F%2Fwww.roesingercre.com%2Fresources%2Findustrial-land-development-texas)[Post on X](https://twitter.com/intent/tweet?url=https%3A%2F%2Fwww.roesingercre.com%2Fresources%2Findustrial-land-development-texas&text=Industrial+land+development+in+Texas&via=LandmanZachATX)

**Short answer:** Industrial land development in Texas runs through five gates: control the land, confirm utilities and jurisdiction, entitle and plat the site, permit construction (including TCEQ stormwater coverage and any TxDOT driveway permit), then build and lease. Budget land, hard costs, soft costs and carry. The test is yield on cost: stabilized NOI divided by total project cost should clear the market cap rate by a meaningful spread, often 100 bps or more.

## The development sequence

1. **Land control.** Contract with a long feasibility period, or an option, so you can spend on studies before you are committed.
2. **Feasibility.** Survey, title, Phase I environmental, geotechnical, floodplain, utility capacity letters and a zoning or jurisdiction check. Run a residual land value model. See our guide to [land price per acre around Austin and I-35](https://www.roesingercre.com/resources/land-price-per-acre-austin-i35?hsLang=en).
3. **Entitlements.** Zoning or a planned development district inside a city; in the county or ETJ, subdivision and development rules still apply.
4. **Platting and site plan.** Plat the lot, then submit civil drawings and a site plan for grading, drainage, utilities, fire lanes and parking.
5. **Permits.** Building permit, stormwater coverage, driveway permits and utility service agreements.
6. **Construction and lease-up.** Shell first, then tenant improvements as leases are signed.

## Entitlements, platting and site plans

### Zoning and jurisdiction

Inside city limits, confirm the zoning allows warehouse, manufacturing or outdoor storage, and read the conditional-use list. Outside city limits, Texas counties generally have limited zoning power, which can make county sites faster for some uses, but subdivision, floodplain and fire code rules still apply. Since [Senate Bill 2038](https://capitol.texas.gov/tlodocs/88R/analysis/html/SB02038S.htm) took effect on September 1, 2023, owners of land in a city's extraterritorial jurisdiction have had a petition process to seek release. That changes negotiating dynamics with some cities, and parts of the law have been challenged in court, so get a land use attorney's read on your tract.

### Plat approval timing

Texas law sets a short clock for plats. Under [Local Government Code section 212.009](https://texas.public.law/statutes/tex._local_gov%27t_code_section_212.009), a city generally must approve, conditionally approve or disapprove a plat within 30 days of filing, with limited extensions. In practice, the time goes into pre-application meetings and getting to a complete filing, so build that into your schedule.

### Site plan

The site plan sets truck courts, dock positions, trailer parking, fire access, landscaping and impervious cover. Impervious cover limits and setbacks often decide whether a 10-acre site fits a 120,000 SF building or a 90,000 SF building.

## Utilities, MUDs and PIDs

- **Water and wastewater.** Get a written service commitment from the CCN holder with capacity, impact fees and the cost of any line extension or lift station.
- **Power.** Industrial users ask about amperage early. Confirm three-phase service and the utility's lead time for transformers.
- **MUDs.** A municipal utility district is a special-purpose district that provides utility service to a defined area, created through the [TCEQ](https://www.tceq.texas.gov/agency/subjects-of-interest/utilities/municipal-utility-districts) or by the Legislature. MUDs commonly fund infrastructure with bonds repaid by a district tax, which raises the occupancy cost a tenant compares against other sites.
- **PIDs.** A public improvement district lets a city or county fund improvements through assessments on property in the district. Like a MUD tax, the assessment flows into the tenant's NNN expenses.

## TCEQ stormwater, detention and TxDOT access

### Construction stormwater

The [TCEQ construction general permit (TXR150000)](https://www.tceq.texas.gov/downloads/permitting/stormwater/general/construction/txr15fact.pdf) generally covers sites that disturb one acre or more. Large sites (five acres or more) generally file a Notice of Intent and must have a Stormwater Pollution Prevention Plan in place before work starts; small sites follow lighter rules but still post a site notice. In the Edwards Aquifer recharge and contributing zones, additional TCEQ rules can apply.

### Detention and drainage

Most jurisdictions require that post-development runoff not exceed pre-development runoff. That usually means a detention pond, which can take a meaningful share of a site depending on soils, slope and local rules. Price it as lost buildable area, not just as a construction line item.

### TxDOT access

A new or modified driveway on a state highway requires a [TxDOT access driveway permit](https://www.txdot.gov/manuals/des/acm/chapter-2--access-management-standards/section-4--driveway-permits--design--and-materials/permits.html), and spacing standards can limit where curb cuts go. If your truck access depends on a frontage road cut, settle it in feasibility.

## Timeline and budget

| Phase | Typical duration (varies widely) | Main cost items |
| --- | --- | --- |
| Feasibility | 60 to 120 days | Survey, Phase I, geotech, engineering studies, legal |
| Entitlements and platting | 3 to 12 months | Zoning, plat, civil engineering, fees |
| Site plan and permits | 2 to 6 months | Civil and architectural drawings, permit and impact fees |
| Shell construction | 7 to 12 months | Site work, slab, tilt wall or metal, roof, utilities |
| Lease-up | 0 to 12+ months | Leasing commissions, TI, free rent, carry |

These ranges are general planning assumptions, not guarantees. A county site with utilities at the line can move faster; a rezoning with neighborhood opposition can take much longer.

## Build-to-suit vs spec

- **Build-to-suit.** A tenant signs a lease before construction. Lease-up risk is gone, financing is easier, and the developer accepts a lower yield on cost. Risk shifts to construction cost and delivery date.
- **Spec.** The developer builds without a tenant. The reward is a higher target yield and market rent at delivery; the risk is vacancy, carry and leasing cost if demand softens.

In smaller Texas markets, small-bay and multi-tenant spec buildings can lease faster than big boxes because the tenant pool is deeper. See our guide to [small-bay industrial investing](https://www.roesingercre.com/resources/small-bay-industrial-investing?hsLang=en).

## Worked example: yield on cost

Illustrative assumptions for a 100,000 SF spec building on 8 acres:

| Line item | Math | Amount |
| --- | --- | --- |
| Land | 8 acres x 43,560 SF x $6.00/SF | $2,090,880 |
| Hard costs | 100,000 SF x $115 | $11,500,000 |
| Soft costs | 15% of hard | $1,725,000 |
| Financing, carry, leasing | Estimate | $900,000 |
| Total project cost | | $16,215,880 |
| Stabilized NOI | 100,000 x $13.00 x 95% less $30,000 | $1,205,000 |
| Untrended yield on cost | $1,205,000 / $16,215,880 | 7.43% |

If stabilized buildings like this sell at a 6.50% cap rate, value is $1,205,000 / 0.065 = about $18,538,000, a development margin of roughly $2,323,000 (about 14% on cost). The spread between a 7.43% yield on cost and a 6.50% exit cap is 93 bps. If costs run 10% over budget, total cost rises to about $17,837,000, yield on cost falls to 6.76% and the margin shrinks to about $701,000. That sensitivity is why most developers want a spread of 100 to 150 bps before they commit. For how cap rates set exit value, see [cap rates and commercial property value](https://www.roesingercre.com/resources/cap-rate-commercial-property-value?hsLang=en).

## Frequently asked questions

### How long does it take to develop an industrial building in Texas?

From land contract to a finished shell, many projects take roughly 18 to 30 months, depending on entitlements, utilities and permitting. Sites with zoning and utilities in place move faster.

### What is a good yield on cost for industrial development?

Developers generally look for yield on cost to beat the market exit cap rate by 100 to 150 basis points or more, so they are paid for construction and lease-up risk. The right spread depends on the market and the tenant risk.

### Do I need a TCEQ stormwater permit to build a warehouse?

Generally yes if the project disturbs one acre or more. Large sites of five acres or more typically file a Notice of Intent and prepare a Stormwater Pollution Prevention Plan; confirm requirements with your civil engineer.

### What is the difference between a MUD and a PID in Texas?

A MUD is a special district that provides utilities and typically levies its own tax to repay infrastructure bonds. A PID funds public improvements through assessments on property within the district; both add to occupancy cost.

This guide is general information, not legal, tax, engineering or investment advice. Durations, costs and rents in the examples are illustrative assumptions, not current market data; confirm requirements with your civil engineer, land use attorney and local jurisdiction.
